According to the terms of the software development agreement, the user fully understands and expressly agrees that the use of Team Outsource Software SRL (Toss) products and services are at the user’s sole risk, and that the user will be solely responsible for any damage to his/her computer system or loss of data resulting from the use of such product(s), service(s) and/or data. Team Outsource Software SRL products are intended for use at user’s own discretion and therefore cannot be reproduced or redistributed without prior written agreement with Team Outsource Software SRL. Source code is considered property of Team Outsource Software SRL unless other is negotiated and agreed upon in written form.

The user understands and agrees that Team Outsource Software SRL’s products and services are provided "AS IS", therefore, Team Outsource Software SRL disclaims all warranties of any kind, either expressed or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose or non-infringement. Team Outsource Software SRL makes no warranty or representation regarding the results that may be obtained from the use of our products and/or services.

Team Outsource Software SRL shall not be liable for any damages whatsoever, and in particular for any special, direct, indirect, incidental, consequential or punitive damages of any kind that result from the use of or the inability to use Team Outsource Software SRL’s products and/or services, including but not limited to damages for loss of profits, revenue, use, data or other intangibles, even if Team Outsource Software SRL had been advised of the possibility of such damages.
